– Terms & Conditions of booking –

Booking fees, cancellations and postponements

All bookings are subject to confirmation of receipt of a non-refundable booking fee to secure your date. We’re sorry that we have to take this payment upfront, but unfortunately, this is necessary to ensure that we don’t reserve valuable time slots for people who don’t turn up(!) If the Client needs to postpone or amend the date of the booking (for example due to sickness) they should notify the Studio in writing as soon as possible so we can endeavour to arrange another suitable date for the photoshoot. Should the Client wish to cancel a booking, they can do so at any time by giving written notice to the Studio, but in doing so shall forfeit any monies already paid. If the Studio is forced to cancel the agreement, any fees and deposits will be reimbursed in full.

What’s included

All shoot fees include our time and talent to create and process your images. Some packages may include additional products, whereas others do not. Please refer to your personal chosen package/quotation to see full details of exactly what is included in your package. All additional available products and prices are freely available for viewing on our website, which we encourage all clients to view prior to booking with us.

Pricing

Our products, services and prices do change from time to time, but current pricing will always be clearly marked at the time of ordering. All prices exclude delivery unless otherwise stated.

Minors

Any persons under the age of 18 years must be accompanied by a responsible adult at all times.

Image editing and retouching

All image sizes are nominal and images will be colour corrected using fully calibrated equipment. Retouching, digital manipulation and artistic finishing is done at the Studio’s discretion. Our editing process first includes removal of test images, duplicates and any images deemed to be sub-standard or unnecessary (for example blinks, odd expressions and technical failures such as if a flash fails to fire). The remaining selected images will be edited to a standard consistent with those displayed on our website and blog. This editing process includes general density and colour tone adjustments and cropping as deemed appropriate by the photographer in order to produce a set of images suitable for printing.

Image delivery and file retention

All finished images will be made available for viewing and ordering, no later than one month following the shoot date, and copies of finished images will be archived at no extra charge for a period of 3 months. Unfortunately, due to the vast amount of images we produce each year we are unable to store and archive images indefinitely, so after an initial 3 months free archiving period the Studio will no longer be responsible for the care, archiving, backup or maintenance of any images, and makes no guarantee that copies will still be available in the future: please be sure to save, print and backup your files carefully!

Unpurchased or unwanted files

Because we are unable to store images indefinitely, images not purchased within 3 months after your photoshoot will be considered unwanted and may be deleted from our systems without further notice. Deleted images will no longer be available for purchase, so we encourage all Clients to make any purchasing decisions as soon as possible after their photoshoot.

Copyright

Any images or copies of images whether stored digitally or otherwise are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically / electronically or by any other means, an image created as part of this agreement without the permission of the Studio in writing. All original files and copyrights shall remain the property of Studio. Any portion of the work delivered to the Client is for the Client’s personal use only and the Client may not sell or reproduce, or post online, nor authorise the sale or reproduction of any portion of the work without the Studio’s written consent. The Client may not alter or manipulate any images supplied in any way without the written consent of the Studio.

Client’s usage rights

Any digital images supplied to the Client will include written personal usage rights so that the Client can copy, print or reproduce images produced and supplied for their own personal use. Commercial clients will receive written image rights for commercial use.

Client photography

The Client acknowledges that the taking of photographs and/or video by Clients during photo sessions is prohibited, and may lead to the photo session being immediately terminated without refund.

Files delivery for overseas customers

For speed and convenience, any digital media destined for customers living overseas will be made by direct download within one month after the shoot date. Digital media for UK customers may be delivered either by direct download or on USB (depending on your chosen package).

Product orders

All products must be paid in full before being released to the Client, and due to the custom nature of our work, all orders are final and cannot be changed or cancelled after purchase.

Location photography

For any photography conducted outside of the Photographer’s studio premises, coverage is deemed to begin when the Photographer arrives on site and ends when the Photographer leaves. Unless otherwise stated, all hours of coverage are based on a continuous block of consecutive hours. In the event that the coverage takes longer than the expected amount of hours quoted, additional hours will be charged at our standard overtime rate, billable in 1/2 hour increments.

Additional location expenses

The Client agrees that any additional expenses incurred by the Photographer in order to complete the agreed coverage will be charged to, and paid for by the Client. Additional expenses include, but are not limited to, parking fees, toll charges, permit charges, and admission charges if applicable.

Special Requests

The Client understands and accepts that the photographic coverage will be as the Photographer’s professional expertise determines and no single photograph will be deemed more important than another. Special requests are not binding instruction, although every effort will be made to comply with the Client’s wishes. Any special requests must be made in writing prior to the event date. The Photographer cannot guarantee delivery of any specific images but will attempt to meet all reasonable requests.

Image display

In order to operate our business, it is essential that we are able to display examples of our work to new prospective customers. The Client permits, and the Studio reserves the right to display any images created, in their studio, portfolios, website, and marketing, in a tasteful manner consistent with the images previously displayed on our websites. Clients with specific personal privacy issues such as those in the public eye should discuss any non-disclosure requirements directly with the Studio prior to booking.

Limitation of Liability

In the unlikely event of total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

Complaints

In the unlikely event of any complaint, this should be raised by the Client with the Studio in writing, within 28 days of receipt of the images.

– Cookies –

European law tells us we need to explain what cookies are. Like most modern websites, our websites use cookies to tailor and improve your user experience. We’ll assume you’re OK with this, but if not, you can adjust the browser settings on your computer to disable cookies being stored on your computer. However, this may prevent our website and others from functioning properly.

What are cookies?

Cookies are very common, small text files, stored on your computer when you visit many websites. We use cookies to help identify your computer so we can tailor your user experience, track shopping basket contents and remember where you are in the order process.

The following are necessary for our websites to operate.

Our websites will:

  • Remember what is in your shopping basket
  • Remember where you are in the order process
  • Remember if you are logged in and that your session is secure. You need to be logged in to complete an order.

The following are not strictly necessary but are required to provide you with the best user experience and to tell us (anonymously) which pages our clients find most useful and interesting.

Our websites will:

  • Track the pages you visit via standard Google Analytics or Statcounter
  • Allow you to share pages with social networks such as Facebook (if available)

What information is being collected?
We collect a variety of information before, during and after you book with us or use any of our services, including;

  • Names, addresses and contact information of the person(s) placing an order with us.
  • Names, addresses and contact information of the person(s) using our services.
  • Names (and in some cases ages and gender) of all participants of a photoshoot.
  • Details and notes taken throughout a photo session or service provided, to help us remember conversations during and details of your session.

If you email us or send us messages via social media, these messages are stored within our email system or social media accounts. If you telephone us, we may make notes on our system to help us provide a service to you. These messages are stored for as long as practicable to allow us to provide you with better future services.

Who is collecting the data?
This data is being collected by Robert Hooper Photography Ltd. We use a password protected data management software system to hold our data.

How is it being collected?
The vast majority of our data is collected directly from you, either by filling out an online form or telling us face to face, via the telephone, email or message. In some cases, data may be given to us by a third party. This includes if somebody purchases a voucher or photoshoot for you, whereby they will usually give us your name and details to allow us to process their order, and provide our service to you. This also includes any details sent to us by partners who pass details on to us that were given by you, with your consent to forward to relevant trusted suppliers.

Why is it being collected?
Most of the data we collect is solely for the purpose of providing you with a service you have ordered or had ordered for you. Some of the data we collect is to help provide you with a better customer service experience. We are required by law to collect and store certain information relating to any order you place with us.

How will it be used?
Data we collect will be used by us to enable us to provide our services and products to you. Contact data may be used to send you direct offers from us about upcoming promotions or newsletters, and these can be unsubscribed from at any time. We may internally analyse data for business and forecast purposes. Robert Hooper Photography has a legitimate interest in using images taken in relation to your booking and may use these images in the following ways, although you are free to refuse this use of these images:

  • On our website for promotion & advertising purposes
  • On social media for promotion & advertising purpose
  • For marketing materials (business stationery, flyers, business cards etc) or publications/print

Who will it be shared with?
We take your privacy very seriously. We do not sell your data to third-party organisations. There are a few scenarios where some of your data may be shared with third parties to allow us to provide our services to you. These include:

  • Delivery and Postage service providers to allow us to send you documentation and orders you have placed (information shared includes name, address and in some cases email address / mobile number).
  • Manufacturers (our printing labs) if we are sending an order directly to you from a lab (information shared includes name, address and in some case email address / mobile number).
  • Law enforcement and legal requirements: we will provide data to law enforcement agencies if issued with a court order to do so.

How will this affect you?
We collect, store and process your data in such a way that should have no negative effect on you as an individual.

How long is the data stored?
Most data we collect is stored indefinitely. This is to allow us to provide a better service to you as a customer in the event that you contact us again in the future. We are also legally obliged to store some data for a minimum amount of time, for example, sale order records and payment records etc.

Access to stored data.
If you have any questions about the data we hold about you, please feel free to contact us. As well as trying to help you directly, you may request a copy of any data we store about you and we will comply with any requests as per the guidance of the Information Commissioner’s Office.

Our studio is located in Copthorne West Sussex. Our nearest towns include Crawley, East Grinstead, Horley, Horsham, Redhill, Reigate, Royal Tunbridge Wells, Burgess Hill and Brighton.

 

We are just 5 minutes from junction 10 of the M23 motorway, 15 minutes south of the M25 motorway, with easy rail links to London via Gatwick Express.
